Newsflash: No Proportionality Required For Section 21 Eviction
The Supreme Court today ruled unanimously that county courts do not have to consider the proportionality of evicting a residential tenant in the private sector in the same way they do when the landlord is a public authority. That’s a very sensible decision, as having to consider proportionality would probably have meant every case needed a hearing, thereby shredding the ‘accelerated possession’ procedure.
