As a landlord, you are obliged to ensure that the property is safe for any tenants, prior to their
occupation. We have detailed below your responsibilities, which as a landlord you must
comply with. We can arrange for the necessary contractors to provide you with the relevant
certificates. The information we have provided is for guidance only, more detailed information
can be gained through the relevant sources.
The landlord must ensure that all gas appliances or installation pipe work in the property is
maintained in a safe condition. All such appliances and pipe work must be checked annually
by a Corgi registered Engineer and "The Gas Safety Report" obtained. This report must be
kept for at least two years. The tenant must be provided with a copy of the report within
twenty-eight days of the report being carried out, however, with a new tenancy the tenant
must be provided with a copy of the report at the time they take occupation. If the landlord
does not comply with these regulations and were found guilty, he will have a criminal record
and face a fine, imprisonment or both.
Once you have the gas safety report, please check the report to ensure that all gas
appliances are listed on the report.
Furnishings such as mattresses, bed bases, cushions, padded headboards, sofas, armchairs,
chairs etc are required to comply to the regulations, with the exemption of furniture/furnishings
manufactured before 1950 and after-1989.
You will know if the furniture complies, as there should be labels attached. If there are no
labels, then you must provide proof of the date of purchase.
By selling, giving or leaving the furniture for the tenants, this does not avoid the regulations
and is still considered supplying. Non-compliance can mean that you will be found guilty of a
criminal offence and face a fine, imprisonment or both.
Items such as bedcovers including duvets, loose covers for mattresses,
pillowcases, curtains, carpets or sleeping bags are exempt.
At present, there is no mandatory requirement for electrical equipment to be checked or
undergo regular testing, but a constant duty of care remains. You should have all appliances
and electrics (sockets, plugs and wiring etc) checked before the commencement of a tenancy
and on a regular basis thereafter.
It is recommended that one smoke alarm should be fitted on each floor of the building. For
new buildings it is mandatory that mains powered smoke alarms are fitted.
The General Product Safety Regulations 1994 specify that any product supplied in the
course of a commercial activity must be safe. In the case of letting, this would include
both the structure of the building and its contents. Recommended action is to check for
obvious danger signs - leaning walls, broken glass, sharp edges etc., and also to leave
operating manuals or other written instructions about high risk items, such as hot surfaces,
electric lawnmowers, etc. for the tenant.
